Domestic Violence

jailKansas Domestic Violence Attorney

Kansas laws concerning assault, domestic battery, and protection from abuse orders are far reaching. Often people who have been charged in a domestic abuse case or have no contact motions filed against them fail to understand the long-term implications.

In criminal cases a prosecutor may offer a deal which, on its face, appears like something a defendant should take advantage of when the prosecutor is unable to contact complaining witnesses, the complaining witness is unwilling to cooperate, or there is a warrant for the complaining witness' arrest on other cases. Prosecutors have no obligation to disclose this to defense attorneys or their clients, and prosecutors offer these "good deals" as a way for the prosecutor to get some punishment rather than a complete dismissal. A complete investigation and a detailed discussion with the client and other witnesses prevent the client from taking these "sucker" deals.

Domestic violence may involve allegations involving the abuse of spouses, children, domestic partners, relatives, and others. If convicted of domestic crimes, you may lose your rights to vote, to own firearms, to operate certain types of businesses, and more. Each domestic conviction increases the penalties you will face.

John W. Kerns assists individuals with allegations of domestic violence in courtrooms throughout northeast Kansas. The job of an attorney is to be a vigorous advocate on your behalf and to serve your interests. If there has been a protection of abuse (PFA) or protection from stalking (PFS) motion filed against you, you must understand the procedure and what long term penalties may exist.

Often times a separate court of equity (a civil court), not a criminal court, decides these PFA / PFS matters. The burden of proof is different than what is required in criminal courts. Many times these motions are fraudulently filed by individuals in order to gain an upper hand in custody battles or other salacious reason. If a protection form abuse / stalking motion has been filed against you or you have been charged with violating a protection order, accused of stalking or telephone harassment, or are facing penalties, it is necessary that you be advised of all your rights and options.

When you are in need of assistance when filing petitions for protection from abuse or stalking motions or need representation in court, The Kerns Law Office can help. When the respondent hires representation to appear in court, this attorney will cross-examine you when you testify. No attorney will be there to help unless you hire one. It is important to retain an attorney to represent you, cross-examine the respondent and level the playing field.
